Program Summary

Many states require plaintiffs show that the costs of their medical bills are reasonable and customary in the community to be considered as damages in a personal injury lawsuit. In response, defense attorneys have turned to medical billing experts to evaluate the costs of treatments and determine whether the costs of treatments are reasonable. Because of the complexities with medical billing and the novelty of these experts, Courts across the country have struggled with whether or not to admit them under Daubert.
