Program Summary

Litigation often overlaps with psychology, especially in injury litigation. Accidents, injuries, and death have ripple effects that influence how plaintiffs are perceived, how defendants react, and how witnesses perform. Everything is connected. Litigators, claims professionals, anyone involved in the process should know psychological principles are consciously and unconsciously weaponized to maximize damages and achieve “success” no matter the cost. All too often, there is indeed a human cost. This program will provide participants with insights into common strategies and offer realistic, practical tools to confront and diffuse. We work towards the goal of injecting more humanity into the litigation process.

Key topics to be discussed:

  • Understanding Psychological Strategies Commonly Used by Plaintiffs
  • Analyzing Jury Selection Tactics and Mitigating Juror Bias
  • How Psychological Research Is Used in Injury Cases
  • Strategies for Addressing Emotional Distress Claims
  • Defending Against Psychological Strategies in Medical Malpractice, Auto and Other Complex Litigation
  • Psychological Tactics During Deposition and Trial Testimony
