Program Summary

This presentation is designed for attorneys advising clients on estate and trust matters in light of the recently enacted One Big Beautiful Bill Act. It will examine key planning implications, beginning with the review and revision of formula bequests tied to federal exemption amounts. Additional topics will include late allocations of increased GST exemption, basis step-up strategies involving powers of appointment, the income and transfer tax consequences of terminating QTIPs and other irrevocable trusts, and (time permitting) charitable planning opportunities. Emphasis will be placed on how attorneys can thoughtfully adapt existing plans and structure new ones in response to the new legislative landscape.

Key topics to be discussed:

  • Reviewing formula bequests in light of “permanently” higher exemptions
  • Late allocations of increased GST exemption
  • Tax-Free basis step-up planning using powers of appointment
  • Income and transfer tax consequences of terminating irrevocable trusts

This course is co-sponsored with myLawCLE.
